2. Purpose
These Terms of Service (hereinafter "ToS") govern access to and use of the Ember Application, dedicated to tracking intermittent fasting and managing health and wellness habits.
By downloading or using the Application, you unconditionally accept these ToS.
3. Application Features
- Free access: basic fasting tracking, reminders, statistics.- Premium access: unlock all fasting methods and additional features.4. Registration and Access
- Using certain features may require creating a user account.- You commit to providing accurate information and keeping it up to date.- The Application is reserved for persons over 18 years of age.5. Subscriptions and Payments
- Ember offers monthly and annual subscriptions, accessible via the Apple App Store platform.- Payment, renewal, and cancellation conditions are those defined by Apple distribution platforms.- All subscriptions are automatically renewed unless canceled before the renewal date.- No refunds can be made directly by the publisher, in accordance with App Store rules.6. Application Usage
- You commit to using the Application only in compliance with applicable laws.- It is forbidden to attempt fraudulent access to servers, modify, or damage the Application.7. Personal Data and Privacy
- Ember complies with applicable data protection legislation, including the General Data Protection Regulation (GDPR).- Collected data is used solely for the proper functioning of the Application (tracking statistics, service personalization, subscription management).- You have the right to access, rectify, and delete your data by writing to: mus@tryember.eu.- For more details, please consult the Privacy Policy. 8. Health and Liability
- Ember is not a medical device.- The information and advice offered in the Application are for informational and educational purposes only.- They in no way replace the advice of a healthcare professional.- The user remains solely responsible for their health status and fasting practices.- The publisher disclaims all liability in case of inappropriate use of the Application.9. Intellectual Property
- All elements of the Application (texts, graphics, logos, code, etc.) are protected by intellectual property law.- Any unauthorized reproduction, modification, or exploitation is prohibited.10. Termination
- You can delete your account at any time via the Application.- The publisher reserves the right to suspend or delete an account in case of abusive use or non-compliance with the ToS.11. Applicable Law and Jurisdiction
- These ToS are governed by French law.- In case of dispute, and after an attempt at amicable resolution, exclusive jurisdiction is attributed to the competent French courts.
